A statement to
the Public opinion
While I am about
to enter the court room of the High Iraqi Criminal Court , I
would like to announce the following:
·
On the 6th
of September 2006, the Iraqi police found the body of
lawyer Abdul Munim Hussein after he was kidnapped on Aug.29th2006
in Kadhimiya (Baghdad). His body was found in front of
kadhimiya hospital, about three kilometers for from the
place where he was kidnapped. The martyr lawyer is a member
of my office and has been working with me on several cases
and has worked also on preparing the defense in cases that
are been still going on before both the high Iraqi Criminal
and the Central Criminal Iraqi courts.
The vile
assassination took place in the aftermath of two attacks
which targeted me, my office and it's staff.
My office was a
target to a deliberate act of incendiarism by pouring
benzene in the entrance of the office during the second half
of last June. The firemen controlled the fire only after it
destroyed part of it.

On Aug.23rd,2006,
nine armed men traveling in three cars, stormed in to my
house. They were carrying their weapons overtly in sight of
the public including members of the Iraqi police who were
standing by a nearby check point. Those armed men tied the
guard of the building and aimed their arms (pistols and
rifle guns) to the heads of the office staff threatening to
kill them if they did not inform them about my whereabouts.
Then they scattered the contents of the office, seized many
documents, files and instruments. They withdrew and left the
place in the sight of all those who were there including
some policemen and who did not intervene. The assassination
of the martyr lawyer Abdul Munim Yassien Hussein, combined
with other acts of assassination of lawyers Sadoun Anter
Janabi, Adel Zubeidi and Khamis Obidi, is evidence that the
Defense is targeted in Iraq and that the least minimum of
security which supposed to be provided is entirely
non-existent? This makes it impossible for the lawyers to do
their job and it undermines any real opportunity to achieve
justice.
I herby declare
the following:
·
I consider the
Iraqi government, along with all security bodies and active
militias which enjoys the government protection and under
its control, the occupying forces, especially the American
and the British forces responsible for all the harm I have
suffered or may suffer in the future.
·
I’ve asked my
family, in case I face an accident to take legal action
against president bush and Prime Minister Blair and to
consider them responsible for any such accident because they
are responsible for the current situation in Iraq.
·
I demand that a
real and clear investigation shall be opened to unveil the
facts and to bring the criminals to justice without any
procrastination or delaying. We have become tired of the
promises from the American and the Iraqi sides.
·
We should be
provided with any documents and informed of any measures
which may prove that the American side is serious in its
efforts to get the approval of the neighboring in countries
to allow us and our families to reside in these
countries.
·
I demand to
provide real protection for me and for all my assistants and
to all my colleagues who are involved in cases before the
Iraqi Criminal Court. I draw the public attention the fact
that threats, assaults and incitement have also been
directed against those lawyers who did not appear the
cameras.(whose identities are unidentified by the public)
·
I draw the
attention of the legal organizations and bars associations
in the Arab world and throughout the world to the fact that
no lawyer is secure in Iraq and that the lawyers are
targeted by the militias and the death squads which commit
crimes against the lawyers with the connivance of some
political and intelligence bodies of the government. This
deprives the clients and the persons who are being currently
prosecuted before the Iraqi high criminal court of their
right to have real defense because of the assassinations,
assaults and the state of terror in which we live from a
long time.

I urge all
governmental and non-governmental organizations, with the
human rights organizations in the lead, to act to provide
protection and secure asylum for the defense and their
families. I also urge them to act in order to stop all the
proceedings before the Iraqi High Criminal Court because of
the total lack of security which makes it impossible to
achieve justice.
·
I call on all our
colleagues in Iraq, in Arab World and the world whether they
are (lawyers, judges, men of law) organizations or
professional associations to condemn the coward criminal
acts which led to the assassination of the noble lawyers. I
call them also to show all kinds of protest and to put
pressure to halt this series of killing and terrorizing the
lawyers in Iraq and to preserve the right of defense.

I state that,
despite all assassinations, assaults and acts of terrorism
which I and my colleagues who appear before the Iraqi high
criminal court face I , and they, will also continue to do
our sacred duty and we will never abandon our clients who
have entrusted us out of our belief that every person
should enjoy his right to have a defense.
