المحكمة العراقية تمنع الدفاع من إبداء
دفوعه

واصلت المحكمة العــراقية الخاصة يوم 5 نيسان حرمان
المتهمين – وبضمنهم الرئيس العــراقي صــدام حسين – من
الحق في الحصول على الوقت وعلى التسهيلات اللازمة
لإعداد دفوعاتهم، وذلك نتيجة ضغط الولايات المتحدة
والسلطات العراقية وذلك بهدف دفع المحكمة قدما وسط
دلائل واحتمالات وقوع حرب أهلية في العــراق.
إن محاميي الدفاع يحتجون على حرمانهم من أي قدر من
المساواة في الأسلحة، حيث أنفق الادعاء العام مبلغا
يقدر بثلاثمائة مليون دولار أمريكي، واستفادوا من
إمكانيات المنظمات غير الحكومية، ومئات الآلاف من
الجنود الأمريكيين، وعشرات من المحامين الأمريكيين
الذين يساعدون الادعاء، وقد تم حشد كل هذه الموارد من
اجل جمع الأدلة طيلة أكثر من سنتين. وعلى النقيض من
ذلك، فإن فريق الدفاع يتكون من محامين متطوعين لا
تتوفر لهم موارد مناسبة أوقدرة على العثور على خبراء
أوشهود، بل أنه لا تتوفر لديهم القدرة على زيارة مواقع
حصول الجرائم المزعومة، وذلك بسبب انعدام الأمن في
العــراق نتيجة الاحتلال الأمريكي المستمر.
بل أن محاميي الدفاع الذين يحضرون من خارج العــراق لا
يستطيعون حتى دخول العــراق من اجل زيارة موكليهم
بانتظام، أما في داخل العــراق فإنه يتم وضع محاميي
الدفاع في حالة إقامة إجبارية حقيقية من دون قدرة على
الوصول إلى الهواتف أوالفاكسات أوأجهزة الكومبيوتر
أوالكتب أوأية تسهيلات تلزمهم للقيام بعملهم، بل أن
ملاحظاتهم القانونية تتم قراءتها، ولا يمكن لهم أن
يمرروا أية أوراق إلى موكليهم إلا إذا صادق عليها
مسؤولون أمريكيون.
ويقول البروفيسور كيرتس دوبلر، وهومستشار قانوني
أمريكي لفريق الدفاع، أن هذه الظروف تنتهك أكثر حقوق
الإنسان أساسية في الحصول على محاكمة عادلة وبشكل يقلل
من الحقوق المعطاة للمتهمين إلى حد لم يسبق له مثيل في
العــراق، ومن غير المعقول أن يظل المجتمع الدولي
يراقب بصمت هذه العملية التي يتواصل فيها انتهاك حقوق
الإنسان بشكل متزايد يوما بعد يوم. وقد سبق أن دعونا
إلى إخضاع المحاكمة إلى إشراف الأمم المتحدة، وعلى
الرغم من أن الجميع يوافقون على أنه لا يتم احترام
حقوق الإنسان في هذه المحاكمة، إلا أن الولايات
المتحدة ترغم الجميع على عدم الوقوف إلى جانب حقوق
الإنسان.

The Iraqi Special Court Denies Defence request for
time to prepare
5 April 2006
On 5 April 2006, the Iraqi
special Court again denied the defendants, including
Iraqi President Saddam Hussein, the right to time
and facilities to prepare a defense bowing to US and
Iraqi authorities’ pressure to push the trial
forward in the mist of an unfolding civil war in
Iraq.
Defence lawyers argued that they
are being denied any semblance of equality of arms.
The prosecution has spent an estimated three hundred
million United States dollars, had the benefit of a
host of NGOs, hundreds of thousands United States
troops, and dozens of American lawyers to assist
them. All these resources have been deployed to
collect evidence for more than two years.
By contrast the defence team
consists of volunteer lawyers without adequate
resources or the ability to find experts, adequate
witnesses or even visit the sites of the alleged
crimes because of the state of insecurity in Iraq
under the United States’ continuing occupation.
Defence lawyers coming from outside Iraq cannot even
enter Iraq to visit their clients regularly. In
Iraq, defence lawyers are held under virtual house
arrest without access to telephones, faxes,
computers, books, or any adequate facilities to do
their work. Even their legal notes are read and only
papers approved by American officials can be passed
to their clients.
“Such conditions violate the most
basic human rights of fair trial and provide
defendants in Iraq fewer rights than they ever had
before,” said Professor Curtis Doebbler, an American
advisor to the defence team. According to Professor
Doebbler, “it is quite incredible that the
international community silently watches a process
that continues to violate more and more human
rights. We have called to have the trial brought
under United Nations auspices, but while everyone
agrees that human rights are not being respected
they are too intimidated by the United States
government to stand up for human rights.”
